Terms of Service

1. Introduction

These Terms of Service govern the rights and obligations between the seller and the buyer when purchasing artworks through this website.

The seller is not a VAT payer.

The buyer is any natural person or legal entity who orders goods or services through this website.

By placing an order, the buyer confirms that they have read and agree to these Terms and Conditions.

2. Products

The offer mainly includes:

  • original hand-painted artworks

  • printed reproductions (prints) of selected artworks

  • commissioned paintings

Each original painting is a unique work of art. Photographs on the website are for illustrative purposes only, and colors may slightly differ depending on screen settings.

3. Orders

Orders can be placed through the online shop or by contacting the seller directly.

After receiving the order, the buyer will receive an order confirmation via email.

The seller reserves the right to refuse or cancel an order in the case of a technical error, incorrect pricing, or product unavailability.

4. Price and Payment

Prices listed on the website are final unless stated otherwise.

The buyer may pay for the order using the payment methods available in the online shop, for example:

  • credit/debit card

  • bank transfer

  • other payment services by agreement with the seller

The order will be processed after the payment has been received.

For international orders, the buyer may be responsible for any import duties, taxes, or fees required by the destination country.

5. Shipping and Delivery

Paintings are carefully packaged to ensure safe transportation.

Delivery is carried out through courier or postal services.

International shipping is available. The shipping price and estimated delivery time depend on the destination country and will be shown during checkout or communicated to the buyer in advance.

The seller is not responsible for delays caused by shipping companies or customs procedures.

6. Commissioned Paintings

Commissioned paintings are created based on an individual agreement between the artist and the client.

The ordering process includes:

  • consultation and agreement on the painting concept

  • determining the size, technique, and price

  • digital sketch based on photos / description (if necessary)

  • creation of the painting

  • client approval of the finished artwork

  • delivery of the artwork

Before work on the painting begins, a 30% deposit of the total price must be paid.

As this is a personalized artwork created specifically for the client, commissioned paintings cannot be returned or canceled after completion. The received deposit is non-refundable, except in cases where the artist cancels the order.

If the client decides to cancel a commissioned painting, they are required to compensate the artist for lost profit depending on the stage of completion of the artwork at the time of cancellation.

7. Rights and Obligations of the Buyer
  • The buyer may publish the purchased artwork on any website or social media platforms.

  • The buyer may digitize the artwork and print a physical copy for personal use.

  • The buyer can not financially profit from the purchased artwork or use it for commercial purposes unless agreed otherwise in advance.

  • The purchased artwork can not be modified without the author’s consent.

8. Rights and Obligations of the Author
  • The author has the right to refuse any commission without stating a reason.

  • The author has the right to cancel any order (including commissioned work) at any time and refund the buyer for any reason.

  • All copyright to the artwork remains with the author unless agreed otherwise beforehand.

  • The author has the right to publish the artwork online, in their portfolio, or elsewhere unless agreed otherwise before starting the commissioned painting.

9. Withdrawal from the Contract

The buyer has the right to withdraw from the contract within 14 days from delivery without giving a reason, in accordance with applicable European Union legislation.

This right does not apply to:

  • commissioned paintings created to order

  • personalized products

The product must be returned in undamaged condition. The buyer bears the cost of returning the product.

10. Complaints and Damage During Transport

If the package is visibly damaged upon delivery, it is recommended to check the contents in the presence of the courier.

In the case of damage during transport, the buyer must contact the seller as soon as possible after receiving the shipment.

Complaints will be handled individually.

11. Copyright

All artworks remain the intellectual property of the artist.

By purchasing the artwork, the buyer acquires ownership of the physical piece, but not the copyright for reproduction, distribution, or commercial use without the artist’s permission.

12. Personal Data Protection

Personal data of buyers are processed in accordance with applicable data protection legislation and are further described in the Privacy Policy document.

13. Final Provisions

The seller reserves the right to update these Terms and Conditions.
